1. 국내 법령 및 기술기준

  가. 원자력법 제70조 (방사성폐기물의 처분제한)
     
   

원자력안전법 제70조 제2항에서는 "방사성폐기물관리시설등건설ㆍ운영자가 아닌 자는 총리령으로 정하는 종류 및 수량의 방사성폐기물을 땅속에 천층(淺層)처분(동굴처분을 포함한다) 또는 심층(深層)처분 등의 방법으로 처분할 수 없다"고 규정하고 있으며, 동조 제3항에서는 "제2항에 따른 방사성폐기물 외의 방사성폐기물의 처분은 대통령령으로 정하는 방법 및 절차에 적합하게 하여야 한다."고 규정하고 있다.

상기 조항은 폐기시설 등 건설운영자만이 특정한 종류 및 수량 이상의 방사성폐기물에 대한 처분을 수행할 수 있음을 규정하는 것으로, 이는 위원회규칙으로 정하는 종류 및 수량 미만의 극저준위폐기물의 처분은 폐기시설 등 건설운영자 이외에도 수행할 수 있음을 의미하는 것이다.

     
  나. 원자력안전법시행령 제107조 (방사성폐기물 자체처분의 절차 및 방법)
     
   

원자력안전법시행령 제107조 제1항에서는 "법 제71조에 따른 원자력관계사업자(이하 "원자력관계사업자"라 한다)는 법 제70조제3항에 따라 다음 각 호의 어느 하나에 해당하는 방사성폐기물로서 핵종별 농도가 위원회가 정하는 값 미만이 된 것으로 위원회로부터 확인을 받은 방사성폐기물을 소각, 매립 또는 재활용 등의 방법으로 처분(이하 "자체처분"이라 한다)할 수 있다."고 자체처분을 정의하고 있다. 동 조항은 극저준위폐기물에 대한 자체처분의 방법으로 소각, 매립 및 재활용 등을 인정한 것이다.

원자력안전법시행령 제107조의제2항에서는 "제1항에 따라 자체처분을 하려는 원자력관계사업자는 방사성폐기물을 자체처분할 때마다 총리령으로 정하는 바에 따라 자체처분계획서에 관계 서류를 첨부하여 위원회에 제출하여야 한다. 이를 변경하려는 경우에도 또한 같다."라고 규정하고 있다. 동조 제3항에서는 "제2항 전단에도 불구하고 다음 각 호의 기준을 모두 만족하는 방사성폐기물을 자체처분하려는 원자력관계사업자는 제2항에 따른 자체처분계획서를 5년마다 위원회에 제출할 수 있다."고 규정하고 있다. 또한 동조 제4항에서는 "위원회는 제2항 또는 제3항에 따라 제출된 자체처분계획서가 위원회가 정하여 고시하는 자체처분의 방법 및 절차에 적합한지에 대하여 검토하고, 그 결과를 원자력관계사업자에게 통지하여야 한다."고 규정하고 있다. 한편 자체처분계획서의 양식은 원자력안전법시행규칙 별지 제84호 서식으로 규정되어 있다.

     
  다. 원자력안전법시행규칙 제99조 (방사성폐기물의 처분제한)
     
    원자력안전법시행규칙 제94조에서는 "법 제70조제2항에서 "총리령으로 정하는 종류 및 수량의 방사성폐기물"이란 개인에 대한 연간 피폭방사선량이 10마이크로시버트 이상이거나 집단에 대한 총 피폭방사선량이 1맨·시버트 이상이 되는 것으로서 위원회가 정하는 핵종별 농도 이상인 방사성폐기물을 말한다"고 규정하고 있다. 동 조항은 자체처분을 허용할 수 있는 선량기준을 연간 개인선량 및 집단선량으로 구분하여 기술한 것으로, 자체처분이 가능한 극저준위폐기물은 연간 개인선량 및 집단선량 기준치를 동시에 만족하며 또한 원자력안전위원회가 정하는 핵종별 농도기준을 만족하여야 함을 의미하는 것이다.
     
  라. 원자력안전법시행규칙 제100조 (자체처분 신고)
     
   

원자력안전법시행규칙 제95조 제1항에서는 영 제107조제2항에 따른 방사성폐기물자체처분계획서는 별지 제84호 서식에 의한다고 규정하고 있다. 당해 신고서는 원자력안전위원회고시 제2014-03호 별표 1에 명시된 허용기준 및 핵종별 농도를 만족하는 폐기물에 국한하여 적용되는 것으로, 신청서작성-접수-서류검토(현장확인)-통지의 절차에 따라 수행된다.

한편 동조 제2항에서는 “제1항의 계획서에는 위원회가 정하여 고시하는 지침에 따라 작성된 방사성폐기물 자체처분의 절차 및 방법에 관한 서류를 첨부하여야 한다”고 규정하고 있다.

     
  바. 과학기술부고시 제2001-30호
     
    원자력안전위원회고시 제2014-3호 제2조 (정의)에서는 원자력법 시행규칙 제86조의 "처분제한치"에 대한 판정기준을 제시하고 있으며, 동 고시 제3조 (허용기준 및 핵종별 농도)에서는 방사성폐기물의 허용기준과 과학기술부장관이 정하는 핵종별 농도를 다음 표와 같이 규정하였다.

* 별표1에 수록되지 않은 알파선을 방출하지 아니하는 방사성핵종의 경우 자체처분 허용농도로서 0.1 Bq/g을 적용할 수 있다.

* 다음 목록에 제시된 모핵종과 그 모핵종의 붕괴로 생성되는 자핵종이 함께 존재하는 경우, 모핵종에 대해서만 허용농도를 적용한다.



     
    과거 과기부고시 제97-19호 제11조 (별도승인)에서 "이 규정에서 정하지 않은 방사성폐기물을 자체처분하고자 하는 원자력관계사업자는 과학기술부장관의 승인을 얻어 자체처분할 수 있다"고 규정한 바 있으나, 고시 제2001-30호로 개정되는 과정에서 이러한 별도승인 조항은 삭제되었다. 이에 따라 동 고시 별표 1에서는 기타 방사성핵종의 제한농도를 "개인에 대한 연간 피폭방사선량이 10 uSv미만이고 집단에 대한 총 피폭방사선량이 1 man-Sv미만이 되는 것이 입증되는 농도"로 별도로 규정하였다. 이는 별표 1에서 정하지 않은 핵종의 경우 처분제한치를 만족하는 농도기준을 신고자 스스로 도출하여 제시하고 계획서에 대한 검토를 통하여 규제기관이 적합성을 확인하여야 함을 의미하는 것이다. 이러한 자체처분 선량기준치의 만족여부는 자체처분 절차 및 방법에 따른 피폭경로 및 시나리오에 대한 피폭방사선량 평가를 통하여 입증되어야 한다.
